Judge James must have known a thing or two about poker.  The ultimate question was, “Is poker predominantly a game of skill or is it a game of chance?”.  And if it was a game of chance then it would be gambling, if it was a game of skill then it is not gambling.  Simple!

Video poker games are mostly a game of chance and therefore these games are banned in Pennsylvania.  Texas Holdem, however, has numerous literature written about it to prove that strategy is require to win.  Many mathematical studies have also been undertaken to prove the strategies and probabilities of winning, which further prove that skill predominates over chance, in Texas Holdem poker.

The accused have been let off their charges of “Unlawful Gambling” and now there is further hope that poker players can challenge state law.  For online players this may be the first step against “Unlawful Internet Gambling” and a way to take on the UIGEA.

Obviously Obama is not going to focus on the UIGEA (Unlawful Internet Gambling Enforcement Act) in his first few weeks of office.  I would hope that the new president will focus on more pressing issues – but of course it would be great if he does lead change to this law early on in his term – so that he doesn’t have to do anything illegal as the President….logging on late at night to join his favorite online poker room…might not be the best move.

We have to hope that enough people in Congress come to their senses soon and realise that the UIGEA does not make sense.  Most importantly, that it does not achieve its aim of trying to regulate online gambling.

If you want something really badly – then you have to fight for it!  If you want to play online casino games and poker, legally, then you have to get organized and have a strategy of attack.  Don’t just sit on the side and complain.

Up until now the people defending this law have been more organized than those trying to oppose it.  But this is about to change, more and more online gamblers are putting together a joint offensive to fight this law.  And, good for them!

Let’s make it legal to play online poker – even in the White House!
